    Agreement Approved

    On 20 October 2008 the Industrial Relations Commission of South Australia approved the South Australian Government Wages Parity (Plumbing, Metal and Building Trades Employees) Enterprise Agreement 2008.

    A copy of the approved Agreement is available from Human Resources in your Agency.

    Proposed Agreement

    The proposed "South Australian Government Wages Parity (Plumbing, Metal and Building Trades Employees) Enterprise Agreement 2008” is currently being considered by employees.  The Unions (AMWU, AWU, CEPU, CFMEU and the UFU) will be conducting meetings with all relevant employees to explain the proposed Agreement and to seek employee support.

    If a majority of the employees support the proposed Agreement at employee meetings an application will be made to the Industrial Relations Commission of South Australia for it to be approved.  The Agreement only has effect if it is approved by the Industrial Relations Commission of South Australia.

    Employee meetings will be held at the following sites by the relevant Union officials.  All meetings will be in paid time.

    At the CEPU Office, 312 South Road, Richmond on Thursday, 2nd October from 8am to 10am

    On Thursday, 2nd October from approximately 2.30pm

    On Friday, 3rd October at 8am

    Industrial Relations Commission Proceedings

    • Mediation – 15 to 23 September 2008

    From 15 to 23 September 2008 Commissioner Steel of the Industrial Relations Commission of South Australia convened voluntary conferences to assist the parties to reach an agreement for a proposed new enterprise agreement to apply to plumbers, metal trades and building trades employees in the public sector.

    The outcome of that process has resulted in a proposed agreement which the Unions support.

    • Dispute Notification – Industrial Action – 10 September 2008

    On 10 September 2008 the Chief Executive, Department of the Premier and Cabinet sought the assistance of the Industrial Relations Commission of South Australia in having the industrial action implemented in support of the Unions’ claim for an enterprise agreement lifted.

    •  Award Application – 10 September 2008

    On 10 September 2008 the Government employers applied to the Industrial Relations Commission of South Australia for an award in lieu of an enterprise agreement on the basis that the parties were unable to reach agreement for a proposed enterprise agreement and there was no reasonable prospect of the parties reaching agreement.  This application resulted in the offer of 27 August 2008 no longer being available.

    The Industrial Relations Commission has not listed the application for hearing

    Approval of the South Australian Government Wages Parity (Salaried) Enterprise Agreement 2006
    On 21 December 2006 the Industrial Relations Commission of South Australia approved the above named agreement. The Enterprise Agreement is operative on and from 21 December 2006 and will remain in force until 21 December 2009.
    Salary and Wage Increases are effective from the beginning of the first pay week commence on or after:
    •  1 October 2006
    •  1 October 2007
    •  1 October 2008

    Ballot Outcome
    The State Electoral Commissioner has advised that the proposed South Australian Government Wages Parity (Salaried) Enterprise Agreement 2006 was supported by a majority of voting employees (90.68%).

    An application seeking approval of the proposed South Australian Government Wages Parity (Salaried) Enterprise Agreement 2006 was filed in the Industrial Relations Commission of South Australia (IRCSA) on 19 December 2006.
    The IRCSA has advised that the application will be heard @ 10.00 a.m. on Thursday 21/12/06.

    It is a requirement that the employer party to an Enterprise Agreement shall, upon receipt, and to the extent that it is practical; display a copy of the Notice of Hearing at the relevant workplace on a noticeboard to which all the employees affected have access.

    Employee Ballot
    In view of the PSA's written support for the Government's offer, Public Sector Workforce Relations (PSWR) has engaged the State Electoral Office to conduct a ballot for the proposed Enterprise Agreement for public sector salaried employees.
    The State Electoral Office has advised that the ballots will be sent to relevant public sector salaried employees on 24 Novemember 2006 and the ballot will close at 9.00 a.m. on Friday, 8 December 2006.

    The State Electoral Office has advised the result of the ballot for the proposed South Austratalian Government Wages Parity (Weekly Paid) Enterprised Agreement 2006.

    Total ballots posted to employees: 7611
    Number of envelopes rejected at scrutiny: 29
    Number of YES ballots: 2917
    Number of NO ballots: 105
    Number of informal ballots: 6
    Total: 3028

    The proposed SA Government Wages Parity (Weekly Paid) Enterprise Agreement 2007 has been overwhelmingly supported by a majority of voting employees. Formal approval of the Agreement by the Industrial Relations Commission of South Australia will be sought in the near future.

    Employee Ballot
    The State Electoral Office has been engaged to conduct a ballot for the proposed Enterprise Agreement for public sector weekly paid employees.     This section provides information in relation to federal weekly paid South Australian Public Sector employees covered by the South Australian Government Wages Parity (Federal) Enterprise Agreement 2005 and its underlying Awards. Clause 4, 'Parties Bound', of this Agreement lists employees, their unions and agencies covered by the Agreement.

    Enterprise Agreements, Awards, Pay Rates and Conditions
    Following the decision on 4 November 2005 by the Full Bench to revoke the 21 CEPU s170MX Awards, on 21 November 2005 the South Australian Government Federal Wages Parity Enterprise Agreement 2005 was certified by the Australian Industrial Relations Commission. The Agreement shall remain in force until 30 December 2007.

    Update
    On 4 November 2005, the Full Bench of the Australian Industrial Relations Commission (AIRC) issued its decision to revoke the CEPU (federal-electrician) and various government employer s170MX Awards. Following this decision, on the 21 November 2005 the AIRC certified the South Australian Government Wages Parity (Federal) Enterprise Agreement 2005.     Industrial Disputes
    Senior Deputy President O'Callaghan of the Australian Industrial Relations Commission convened a conciliation conference on 17 March 2005 to discuss the differences in accordance with a Statement issued by a Full Bench on 10 March 2005. On 21 March 2005, SDP O'Callaghan issued a Statement and Recommendations that outlined proposals made during conciliation by Government representatives that could achieve an agreement and contained recommendations that the CEPU meet with its members to consider that proposal.

    On 9 and 10 February 2005, a Full Bench of the Australian Industrial Relations Commission conducted hearings for an arbitration regarding a dispute between the Government of South Australia and the Communications Plumbing and Electrical Union about wages and conditions for Federal metal trades employees. On 10 March 2005, the Full Bench issued a statement requesting that the parties undertake further conciliation in an attempt to resolve their differences.

    On 8 April 2005, the Full Bench of the Australian Industrial Relations Commission issued its decision following arbitration for an MX award and advice that the CEPU did not accept any other proposal made by Government representatives. That Award provides a wage increase of $30 per week payable to federal metal trade-electricians from 8 April 2005 and has a term of 12 months.

    On 1 October 2004, the AIRC terminated the bargaining period for the CEPU.
    AIRC conciliation conferences have occurred on 13, 20, and 27 October, 8 November and 1 December 2004.
    The documents below were handed down by the Australian Industrial Relations Commission following hearings regarding disputation occurring in relation to the negotiation of the Federal Wages Parity Enterprise Agreement.

    Employee News
    November 2005
    On 4 November 2005 the Full Bench of the Australian Industrial Relations Commission (AIRC) found in favour of the application for revocation of the CEPU (federal-electrician) and various government employer s170MX Awards. Following this decision on 21 November 2005 the South Australian Government Wages Parity (Federal) Enterprise Agreement 2005 was certified by the AIRC. The Agreement shall remain in force until 30 December 2007.

    October 2005
    Following consultation with unions, a postal ballot of all employees was conducted between 12 and 23 September 2005 with a majority of employees voting in favour of the proposed agreement. In order to comply with the Workplace Relations Act 1996, a conditional application was made to the Australian Industrial Relations Commission on 14 October 2005 for certification of the proposed agreement subject to the approval of an application to revoke the s170MX Award applicable to the CEPU and electricians. The application is supported by all parties.

    August 2005
    On 4 August 2005 the proposed enterprise agreement and explanatory material was circulated to all federal metal trades employees for consideration; those documents are below. If the proposal is accepted by a majority of eligible employees then application will be made to the AIRC to certify the agreement and to rescind the s170MX Awards applicable to the CEPU and electricians. The Agreement does not have effect unless it is certified by the AIRC and the MX Awards are rescinded.
